18 U.S.C. § 2257 Record-Keeping Requirements Compliance Statement

1. Age of performers

All models, actors, actresses, and other persons who appear in any visual depiction of actual or simulated sexually explicit conduct appearing or otherwise contained on or available through PMVHero (the “Site”) were eighteen (18) years of age or older at the time of the creation of such depictions.

2. Exempt materials

Some visual depictions displayed on this Site are exempt from 18 U.S.C. § 2257 and 28 C.F.R. Part 75 because they do not portray conduct as specifically defined in those authorities; because they were created prior to July 3, 1995; because they are otherwise exempt; or because they are not subject to those record-keeping requirements for other reasons provided by law. The Site may also display non-explicit materials (for example text pages, logos, or interface graphics) that are not covered by § 2257.

3. Nature of PMVHero (secondary transmitter / hosting platform)

PMVHero is primarily a hosting and transmission platform for user-generated content. Content available on the Site is uploaded by third-party users (“Uploaders”). PMVHero does not act as the primary producer of User Content uploaded by others. Uploaders are responsible for ensuring that content they submit complies with all applicable laws, including age and record-keeping requirements.

4. Custodian of records

With respect to all visual depictions on this Site for which records are required to be maintained pursuant to 18 U.S.C. § 2257 and 28 C.F.R. Part 75:

• Primary producer content: The records required to be maintained are kept by the primary producer of the material (typically the Uploader / content creator who created or first produced the depiction), or by such other person as the producer designates in accordance with law.

For records concerning a specific upload, the appropriate first contact is often the Uploader identified on the video page. PMVHero may forward legitimate inquiries to the relevant Uploader or respond with information we lawfully possess.

5. Uploader certification

By uploading content to PMVHero, each Uploader certifies that:

• Every person depicted in sexually explicit conduct was 18 or older at the time of creation.
• The Uploader has obtained all legally required consents and releases, and maintains all records required under 18 U.S.C. § 2257 / 28 C.F.R. Part 75 (when those requirements apply to that content).
• The Uploader will produce those records to authorized parties as required by law and will cooperate with PMVHero’s compliance and moderation processes.
• The content does not depict minors, CSAM, non-consensual intimate imagery, or other prohibited material under our Terms of Service and Rules.

6. Reporting violations

If you believe content on the Site depicts a minor, lacks required consent, or otherwise violates law or our Terms, notify us immediately at [email protected] with the URL and details. We may remove content, preserve data, ban accounts, and report to NCMEC or law enforcement as appropriate.
